25. POST DATED CHEQUE/ALTERATION IN DATE

 Section 138 - Alteration in date of cheque by payee to revalidate it with consent of the drawer - Held, such alteration cannot be used as a ground to resist the right of the payee or the holder thereof.           Section 138 - Body of cheque - Need not to be written by the signatory to the cheque - A cheque can be filled up by anybody if it is signed by the account holder of the cheque, accepting the amount mentioned therein.  Section 138 - Post dated cheque - Becomes a cheque on the date which is written thereon - Six months period has to be reckoned from the date mentioned on the face of the cheque and not any earlier date on which the cheque was made over by the drawer to the drawee.
